Please read and make sure that you fully understand the
Terms of Use below as by placing an order with GoodSense English, L.L.C., or by
participating in the bulletin boards, chat rooms, or other services that may be
offered, you agree that you shall be fully bound to all terms and conditions
herein. These Terms of Use may be amended at the sole discretion of GoodSense
English.
Guarantee of Satisfaction
If GoodSense English cannot work with your document, we
will return it, and your account will not be charged.
All requests for refunds or adjustments must be made in
writing within 3 working days of the completion date of the job and must include
sufficient information so that we may have an opportunity to make any additional
revisions or suggestions that we believe will address your concerns. If we
decide that we cannot resolve a legitimate complaint, we will provide a refund
provided all edited documents are returned to us within three days and you state
in writing that you will make no use whatsoever of the work that we performed.
Should the work subsequently be utilized by you, we are entitled to our full fee
plus attorney’s fees should legal action be necessary to recover our fee.
If you cancel an order once work has begun on your
document, you will receive a refund minus the cost of the work already performed
($25 minimum). Requests for cancellations must be made in writing. The
determination of the cost of the work that has already been performed shall be
at the sole discretion of GoodSense English.

Confidentiality,
Privacy, and Transaction Security
GoodSense English is committed to protecting your
privacy and security.
All of our business with you is confidential. No
information that you share with us will be sold, exchanged, or used to benefit
someone else.
The personal information (name, phone number, email
address, postal address, and credit card or other financial information) that
you enter on our Job Submission Form or otherwise send to us is processed by a
secure server. We do not give your personal information to anyone except as
needed to process your payment. We do not sell or rent personally
identifiable information to anyone.
We use reasonable efforts to keep the materials that you
send to us confidential. We do not sell or re-distribute any part of the
documents that you send to us. We will not use your business secrets or academic
research to write documents for other customers or for any other purposes.
We will not reveal your identity to anyone without your
permission. We may use our work in promotional material provided that your
identity and proprietary information remain confidential. We may ask you to
comment on the quality of our services, but you are under no obligation to
provide this information.
Any information that we collect to analyze general
trends and usage patterns of our website and services will not be used in any
personally identifiable way.

Security
for Documents Sent as Email Attachments
We cannot guarantee confidentiality for documents
delivered to or from GoodSense English by e-mail. When you send your
document to us, you are responsible for using an appropriate level and type of
security, and GoodSense English will likewise return the documents using an
appropriate level and type of security.

Ethical
Considerations
GoodSense English will not participate in plagiarism of
any sort. Plagiarism means "claiming that someone else's writing or
research is your own." You are responsible for providing accurate and
thorough documentation of work by other people that is cited or referred to,
directly or indirectly, in your document.
By submitting documents to GoodSense English for editing
services, you agree that the documents do not (a) infringe any person's
copyright, trademark, or other proprietary rights or privacy; (b) violate any
applicable law or regulation; or (c) contain viruses or other similar injurious
components. You agree that you will hold harmless and indemnify GoodSense
English and its affiliates from and against any infringement of the copyrights
or other intellectual property rights of any person or entity or other unlawful
activity arising out of our work on your documents.
We reserve the right to refuse to edit materials that we
suspect may involve plagiarism, infringement of copyright, or any other type of
personal, commercial, academic, or professional fraud.
We reserve the right to refuse to edit materials that we
consider offensive, prejudicial, slanderous, libelous, or criminal, or otherwise
objectionable on ethical or legal grounds, including pornography and material
designed to denigrate particular racial, ethnic, gender, or religious groups or
individuals.

Intellectual
and Other Proprietary Rights
You retain all intellectual and other proprietary rights
to your edited documents. The source materials and revised documents do not
become the property of GoodSense English, but GoodSense English has the right to
retain file copies of the materials upon completion of the work.

Restrictions
on Writing and Editing Services
We distinguish between the content and the writing (how
the content is expressed) of an academic paper.
We will not alter or add to the content of any academic
paper. We do not provide fact-checking or research services for academic
papers, theses, or dissertations. You are responsible for the legitimacy of the
ideas, information, and sources cited in your document.
We will edit the writing (the spelling, punctuation,
capitalization, grammar, usage, sentence structure, and coherence) of a document
for any academic class, such as history, science, social science, etc., except
for classes which are designed to teach writing and English language skills,
including ESL classes (for non-native speakers of English) and English
composition classes (for native speakers of English).
University applications: We will not write essays for
university applications, but we will edit such essays after they have been
written.
We will not write or edit essays written in response to
published writing prompts for TOEFL (Test of English as a Foreign Language), TWE
(Test of Written English), or similar tests of English proficiency.

Payment
Information
Work will be charged at the rate stated in the estimate.
There will be additional charges for paper and
other materials, printing, postage, telephone and fax charges, etc., as
applicable.
There is a $15 minimum charge for credit card purchases.
Payment must be made in U.S. dollars.
No completed documents will be returned to you until
your payment arrangements have been approved or verified. If payment must be made upon
initial submission of documents or periodically during the process of our
working on your document, you will be notified.
Payment plans for large projects are available at the sole discretion of
GoodSense English and must be approved in advance and in writing. A late charge
of 1.5% per month of the outstanding balance will be added for each payment received after
the due date on the invoice. Should collection and/or legal action become
necessary for any nonpayment, you will be responsible for all costs incurred in
collecting payments, including but not limited to attorney’s fees and court
costs.

Jobs Accounts are available for electronic documents sent via email only.

Jobs Accounts must be funded with deposits (payments) of at least $20.00 USD.
When your balance decreases to approximately $5.00, we notify you that it
is time for you to replenish your account. You are under no
obligation to replenish your account if you do not wish to continue your
account.
If
your account needs to be replenished sooner than one month after your last
payment, we may ask you to increase the level of funding for the
account. If the current charge for services exceeds the balance in
the account, we will return the completed document upon replenishment of
the account or payment of the outstanding amount.
If
you notify us that you wish to close your account, we will refund your
balance. Accounts that are not active for a period of two years will be
considered closed, and any unused balance will become the property of
GoodSense English.

Estimates
of Costs and Turnaround Times
Upon request, we will send you a free estimate of how
much your job may cost and how long we may need to complete it, based on our
best judgment and on the information that you provide. After we have
reviewed your document, we reserve the right to vary the information in the
estimate based on the level of writing or editing that is required. We
will notify you of any changes to the estimate and must receive your approval
before we begin work on your document.
Estimated turnaround times are assumed to begin when we
receive your documents and obtain approval of your credit card or other payment
method. We cannot guarantee delivery times for the completion of editing or any
other service. We are not responsible for delays due to payment processing
errors, Internet Service Provider failure, or other causes beyond our control.
When we receive your order via email, we send you an
acknowledgement. If you have not received an acknowledgement within twelve hours
of submitting your document, the delay may be due to failure of an Internet
Service Provider; therefore, we recommend that you resubmit your document
and the Job Submission Form.
GoodSense English may be able to provide expedited
service at an additional cost.

Limitation of Liability
GoodSense English uses reasonable care to provide
accurate editing of documents. We assume no liability or responsibility for
errors, omissions, or ambiguities in the editing or other services we provide,
except as expressly set forth in these Terms and Conditions. By placing an order
with us you agree that the liability of GoodSense English will not exceed the
value of the fee that you paid for that order, and that you have made, and will
make, no use whatsoever of the services and materials provided to you by
GoodSense English. GoodSense English will not be liable under any circumstances
for any direct, indirect, incidental, consequential, or punitive damages
resulting from delays, unforeseen costs, or textual errors within documents on
which we have worked or which have been submitted to GoodSense English for any
reason whatsoever. Responsibility for the meaning, accuracy, and use of the
document remains wholly with the customer.
GoodSense English shall not be held liable, if, through
no fault of its own, documents or materials are not processed in a reasonable
time, for example in cases of calamity, natural disaster, power failure,
software or hardware failure, failure of the Internet, and other unforeseen
causes.
In consideration for the services performed by GoodSense
English, you hereby expressly waive any and all past, present, or future claims,
demands, obligations, actions or causes of action, at law or in equity, whether
arising by statute, common law, or otherwise, claims for loss of expenses,
whether for compensatory or punitive damages, or of any other kind whatsoever,
including, without limitation, liability for claims of negligence, breach of
contract, fraud, misrepresentation, strict liability, and breach of express or
implied warranty, arising out of services performed by GoodSense English.
This agreement shall be governed by and construed in
accordance with the laws of the State of New Jersey, United States of America,
without giving effect to any principles or conflicts of law. If any provision of
this agreement shall be unlawful, void or for any reason unenforceable, then
that provision shall be deemed severable from this agreement and shall not
affect the validity and enforceability of any remaining provisions. In the event
of a dispute between GoodSense English and you, you agree to have such dispute
resolved in the courts of the State of New Jersey venued in Camden County, New
Jersey.
